TriFlow Fest 2023 Participant Waiver,  June 15 – 18 2023

RELEASE OF LIABILITY WAIVER and the ASSUMPTION OF RISK

In consideration of being allowed to participate in/at the 2023 TriFlow Fest event

  1. I hereby acknowledge that my attendance and/or participation in the 2023 TriFlow Fest event involves the serious risk of physical injury, permanent disability, death, and/or property loss. I acknowledge that fire dancing is inherently dangerous, and should I myself choose to participate in the act of fire dancing, that I myself might receive injuries requiring medical attention.  These risks include, but are not limited to those caused by:  (a) the actions, inactions or negligence of the organizers of the TriFlow Fest Event and its officers, directors, agents, representatives and volunteers (collectively, “TriFlow Fest”), and attendees; (b) conditions of the venue or equipment used; (c) rules and regulations regarding the activities; (d) weather conditions; and (e) condition of attendees.  I also acknowledge and fully understand that there may also be other risks that are not known or foreseeable at this time.
  2. I hereby elect to voluntarily participate in the event, knowing that the activities may be hazardous to my property and my person.  I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in such activities, whether caused by the negligence of TriFlow Fest, its officers, directors, employees, volunteers, representatives, agents, contractors and other attendees, private property in St-Fortunat at which the event is held and/or any of its agents, and/or any other entities that help support the event (collectively the “RELEASEES”) or otherwise, to the fullest extent allowed by law.
  3. I hereby forever release, discharge, and hold harmless releasees from any loss, liability, damage, or costs, including court costs and attorneys’ fees that may incur due to my participation in said activities, whether caused by negligence or otherwise, to the fullest extent allowed by law.
  4. It is my express intent that this Waiver and Hold Harmless Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE the above-named RELEASEES.
  5. I hereby agree that TriFlow Fest is not liable for acts of God, the weather, or actions taken by government agencies and similar causes.  I understand that tickets are non-refundable even if TriFlow Fest is terminated early or modified due to these causes or conditions beyond control.
  6. I hereby understand and acknowledge that the Refund and Cancellation Policy is:  All sales are final. No refunds or exchanges will be issued, although tickets are transferable.
  7. I hereby understand that this ticket may be revoked by TriFlow Fest for any reason, including assisting people with unauthorized entry to the Event.
  8. I hereby understand that the terms and conditions in this agreement may be changed by TriFlow Fest prior to the Event and the revised terms and conditions in effect at the time I use my ticket for entry to the Event will apply to me.

BY CHECKING “I AGREE” ON THE TICKET PAGE, I HEREBY AFFIRM THAT I AM EIGHTEEN (18) YEARS OF AGE OR OLDER AND THAT I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT FOR MYSELF OR ANY MINOR UNDER MY CARE ATTENDING THE EVENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THIS WAIVER, AND HAVE CHOSEN TO SIGN FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME. I INTEND MY AGREEMENT TO PARTICIPATE TO TRIFLOW FEST TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
